Our Fourth Amendment Rights Are Being Stripped!



We try to keep things humorous here at BroBroBroDude but this seemed kind of important. A couple of days ago the Supreme Court ruled that the police can simply claim they heard something coming from your house and call it the "exigent circumstances" doctrine of the Fourth Amendment, break down your door and arrest you without a warrant. This was the decision made in the case of Kentucky Vs. King. The Fourth Amendment States that 'The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.' What actually happened is that police responded to an unrelated incident at an apartment building when they smelled marijuana coming from the apartment of Hollis Deshaun King. Police knocked on the door and claimed to have heard evidence being destroyed. They proceeded to break down the door without a warrant and arrest King. A lower court upheld the warrantless search and the Supreme Court of Kentucky reversed it. Now The Supreme Court of the United States has reversed the Kentucky courts ruling and upheld a clear violation of our Fourth Amendment rights. The complete article can be found here
